As far as I can tell this guy was picked because he has no track record. The best the Dems could do was promise a "a thorough review in the Senate".
I'm glad that W didn't pick an obvious nutter but other than saying he's not qualified I don't think there's any good way to attack this guy. I wish I thought that was a good thing and many a supreme court justice has not lived up to the expectations of the appointing President but - seeing who the appointing President is I can't help but worry that this guy is a closet fascist.
